SERIF HEALTH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS, OR THAT ANY ERRORS OR DEFECTS WILL BE CORRECTED.
7.2. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SERIF HEALTH, ITS AFFILIATES, SUBSIDIARIES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, OR ANY THIRD PARTIES ASSOCIATED WITH THE SERVICE ("SERIF HEALTH PARTIES") BE LIABLE TO YOU OR ANY THIRD PARTY FOR:
- ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED IN ANY WAY TO THE USE OR INABILITY TO USE THE SERVICE, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF REVENUE, LOSS OF DATA OR INFORMATION, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF SERIF HEALTH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES;
- DAMAGES ARISING OUT OF OR RELATED TO YOUR RELIANCE ON OR USE OF INFORMATION PROVIDED VIA THE SERVICE, INCLUDING BUT NOT LIMITED TO ERRORS, INACCURACIES, OMISSIONS, OR DEFECTS IN DATA OR CONTENT PROVIDED BY SERIF HEALTH;
- DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO, ALTERATION, LOSS, OR DESTRUCTION OF YOUR TRANSMISSIONS, DATA, RECORDS, OR SYSTEMS;

7.3. Cap on Liability
NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS, IF A COURT OF COMPETENT JURISDICTION FINDS THAT SERIF HEALTH OR THE SERIF HEALTH PARTIES ARE LIABLE TO YOU FOR ANY CLAIM OR DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE, THE TOTAL AGGREGATE LIABILITY OF SERIF HEALTH AND THE SERIF HEALTH PARTIES SHALL BE STRICTLY LIMITED TO THE GREATER OF (A) ONE HUNDRED DOLLARS (USD $100.00) OR (B) THE TOTAL AMOUNT YOU HAVE PAID TO SERIF HEALTH FOR ACCESS TO THE SERVICE DURING THE IMMEDIATELY PRECEDING TWELVE (12) MONTH PERIOD BEFORE THE EVENT GIVING RISE TO THE CLAIM.
YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS OF LIABILITY AND DISCLAIMERS PROVIDED IN THESE TERMS OF SERVICE CONSTITUTE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND SERIF HEALTH. WITHOUT SUCH LIMITATIONS, SERIF HEALTH WOULD NOT BE ABLE TO OFFER THE SERVICE UNDER THESE TERMS. THESE LIMITATIONS SHALL APPLY EVEN IF THE LIMITED REMEDY PROVIDED HEREIN FAILS OF ITS ESSENTIAL PURPOSE.
8. Indemnification
8.1. Indemnification Obligation
You agree, to the fullest extent permitted by law, to indemnify, defend, and hold harmless Serif Health, its affiliates, subsidiaries, parent companies, officers, directors, employees, contractors, agents, licensors, suppliers, and successors (collectively, "Indemnified Parties") from and against any and all claims, demands, liabilities, judgments, losses, damages, costs, and expenses (including, without limitation, reasonable attorneys' fees, expert witness fees, court costs, and litigation expenses) arising out of or related to:
- Your use or misuse of the Service, the Website, or any information, data, or content provided by Serif Health;
- Any breach or alleged breach by you (or anyone acting on your behalf, authorized or unauthorized) of these Terms of Service, including specifically any unauthorized or prohibited use of our Website, content, or data;

8.3. Survival of Indemnification
Your indemnification obligations under this provision survive the expiration or termination of your access to the Service, the Website, or these Terms of Service, for any reason whatsoever.
